Ten states with Republican attorneys general sued the Biden administration over the vaccine mandate for health care workers.
Missouri Attorney General Eric Schmitt, Nebraska Attorney General Doug Peterson and Alaska Attorney General Treg Taylor filed the lawsuit along with attorneys general from Arkansas, Kansas, Iowa, Wyoming, South Dakota, North Dakota and New Hampshire.
The coalition led by Missouri’s attorney general says Biden’s mandate “is unlawful under federal law” because it is a regulation that directly affects 17 million nurses and others who do not have the option of periodic Covid-19 testing.
“Missouri will continue to be a national leader in challenging the Biden administration’s illegal edicts. The lawsuit against the health care worker vaccine mandate is our latest effort to push back against an unprecedented federal overreach,” Attorney General Schmitt said on Twitter.
In the lawsuit, the 10 states allege that “the federal government is trying to take away the mandatory vaccination power that has always been the purview of the states and still belongs to them.”
“Federalism allows states to tailor such matters in the best interests of their communities. The heavy hand of CMS’s nationwide mandate does not. This court should thus set aside that rule as unlawful agency action under the Administrative Procedure Act,” the lawsuit states.
The court action comes after a federal court blocked, for the time being, the vaccine mandate aimed at private employers. The vaccine mandate for healthcare workers remains in effect.
Health care facilities that fail to comply with Biden’s mandate face a range of penalties, including fines. According to The Epoch Times‘ sources, they could even be kicked out of the Medicare and Medicaid programs.
Randy Tobler, CEO of Scotland County Hospital in Memphis, Missouri denounced that Joe Biden’s mandate “is about to exacerbate an already alarming shortage” of staff.
