Bolsonaro Signs Decree Banning Social Networks from Censoring Brazilians

Brazilian President Jair Bolsonaro issued a decree on Monday that prohibits social network companies from “arbitrarily” removing content and censoring users.

The text of the decree states that this will guarantee “freedom of expression on social networks” and responds to the “arbitrary removal” of content and profiles.

The decree must be analyzed within 60 days by the Congress, which could veto it, but as long as it is not pronounced, it will be in force as of this Monday.

According to the text, published in the Official Gazette, Internet companies will only be able to remove content with a “just cause” and must first offer users a channel to exercise a “broad defense” before any decision is taken.

It also provides for the “right” to the “restitution of contents”, whether they are texts, images or videos for the users of the networks.

Bolsonaro’s government stated that the removal of content decided only by Internet companies “harms the public debate of ideas and the exercise of citizenship”, which configures “a mass violation of fundamental rights and guarantees”, among which it cites “freedom of expression.”
