BORDER PATROL Chief Raul Ortiz admitted that the Biden administration would be releasing aliens who would not normally be admissible to the country and acknowledged that Democratic immigration policies would be driving mass migration because migrants see no consequences for entering the country violating the laws.
Ortiz said in a hearing with lawyers that never in his 31 years of service at the agency had he seen a memorandum authorizing the mass release of migrants
At issue is “Exhibit 3,” an internal Border Patrol emergency memorandum dated May 19, 2022, titled “Noncitizen releases from U.S. Border Patrol Custody.”
The memo states that border agents would not be able to process and transport large numbers of illegal aliens who would cross the southern border into the U.S. if Title 42 is repealed.
“This guidance is for situations where U.S. Immigration and Customs Enforcement (ICE)/Enforcement and Removal Operations (ERO) are unable to accept custody of noncitizens due to lack of bed space, such that noncitizens must be released directly from USBP custody to avoid overcrowding and excessive time in custody,” the May 19 memo states.
Ortiz’s statements came under oath in the wake of a lawsuit filed by Florida Attorney General Ashley Moody against the Department of Homeland Security and other border agencies.

Border Patrol chief admits U.S. is releasing migrants who would be inadmissible
Counsel from the Florida attorney general’s office asked Ortiz to describe the memo, to which he responded: “It’s a memorandum that I signed on May 19th, 2022, and it discusses the non-citizen releases from our custody.”
Florida’s attorney continued and asked: “In your experience 31 years with the Border Patrol, have you ever seen a document—or have you ever seen a memorandum like Exhibit 3 before?”
Ortiz answered: “No.”
“Would you agree with me that Exhibit 3 deals with the possible rescission of Title 42?,” the lawyer asked.
“Yes”, Ortiz replied.
Counsel continued: “And does Exhibit 3 authorize the release of aliens that would otherwise be inadmissible into the United States.” Ortiz replied: “Yes.”
During the same deposition, Ortiz said Biden’s border policies have “no consequences” for illegal immigrants and are to blame for the unprecedented surge at the border and the release of hundreds of thousands into the interior of the country.
Florida’s attorney general accuses the Biden administration of having only one solution to the surge of illegal migrants in the country: mass releases.
“After the Biden administration denied that they were engaged in catch-and-release, and that they were responsible for the historic surge at our southern border, Florida got the Chief of Border Patrol to admit, under oath, the truth. The Biden administration caused the surge, made the border less safe, and is flagrantly violating the very federal laws they swore to uphold. The Biden administration is putting hard-working border patrol agents in impossible and untenable positions—risking their lives and safety, and I want to thank Chief Ortiz for testifying truthfully at his deposition,” said the Florida Attorney General.
According to the prosecutor’s investigation by July 2021, six months after Biden’s inauguration, the administration released more than 60,000 aliens in a single month. DHS revealed that more than 48,000 illegal immigrants, who indicated they were traveling to Florida, did not check in with ICE. The federal government now has no idea of their location or activity, although most of them are legally inadmissible.
