Servicemen, Army Contractors Join Class Action Lawsuit Against Biden’s Vaccine Mandate

American military, federal employees and other civilian contractors joined in a class-action lawsuit against Joe Biden, the Department of Defense, and Homeland Security over the President’s COVID-19 vaccine mandate.

The lawsuit, filed in Florida District Court, lists President Biden, Defense Secretary Lloyd Austin, and Homeland Security Secretary Alejandro Mayorkas as defendants.

The 24 plaintiffs are asking the court to issue a temporary restraining order to prevent the COVID-19 vaccine mandates from going into effect and ultimately issue an injunction to prevent the Pentagon from enforcing the vaccine mandates.

The military plaintiffs are: two Navy SEALs, a Navy EOD Officer, a Navy Chief Petty Officer, a Navy Chaplain, two Marine Lt. Coneles, two Marine Lance Corporals, an Air Force Commander, an Air Force Technical Sergeant, an Army National Guardsman, an Army Colonel, and a Coast Guard Lieutenant.

Liberty Counsel, the Christian law firm that filed the lawsuit, points out that the plaintiffs “face a deadline under the Federal COVID-19 Vaccine Mandate” to receive the doses and believe the presidential order violates their religious beliefs.

Biden issued an executive order last Sept. 9 requiring nearly all federal employees to receive a COVID-19 vaccine as a condition of employment. Federal civilian employees and contractors have until Nov. 22 to be fully vaccinated.

The lawsuit notes that many of its 24 plaintiffs have been denied their religious exemption requests, while other plaintiffs “have been threatened with dishonorable discharge, court-martial, dismissal, or other life-altering disciplinary action” for seeking such exemptions.

“The Biden administration has no authority to require the COVID shots for the military or for federal employees or civilian contractors. Nor can the Biden administration pretend that the federal Religious Freedom Restoration Act and the First Amendment do not apply to its unlawful mandates,” Liberty Counsel founder and president Mathew Staver said in a statement.

“Forcing the COVID shots without consent or consideration for their sincere religious beliefs is illegal,” he said.
