In the Supreme Court’s first decision since the day a leaked draft opinion that would overturn Roe v. Wade made headlines, Senator Ted Cruz found himself the victor in an important case affecting campaign finance laws.
The Supreme Court ruled in favor of Cruz that the use of campaign funds can be used to repay personal campaign loans. Chief Justice John Roberts wrote the 6-3 decision and Justice Elena Kagan wrote the dissent for the liberal justices Stephen Breyer and Sonia Sotomayor.
“The question is whether this restriction violates the First Amendment rights of candidates and their campaigns to engage in political speech,” Roberts wrote. He said there is “no doubt” the law burdens First Amendment rights, citing the established presented that “When the Government restricts speech, the Government bears the burden of proving the constitutionality of its actions.”
“Any such law must be at least justified by a permissible interest,” Roberts added. Justice Kagan dissented with Chief Justice Roberts’ arguments.
“In striking down the law today, the Court greenlights all the sordid bargains Congress thought right to stop. . . . in allowing those payments to go forward unrestrained, today’s decision can only bring this country’s political system into further disrepute,” Kagan opined.
The 6-3 decision largely conforms to the 5-3 draft decision that would overturn landmark abortion cases Roe v. Wade and Planned Parenthood v. Casey, as was made public in an unprecedented opinion leak in early March.
“We therefore hold the Constitution does not confer a right to abortion. Roe and Casey must be overruled, and the authority to regulate abortion must be returned to the people and their elected representatives,” Alito writes in the document, labeled as the ‘Opinion of the Court.’ The Supreme Court opinion leaker has not yet been found, despite Chief Justice Roberts earlier announcing an internal investigation.
Pro-abortion activists have been organizing in opposition to the upcoming ruling and Democrats have also started fundraising in the hopes of mobilizing its base to turn out heavily for the upcoming midterm elections. The Supreme Court decision could ultimately come as early as this week.
