The Biden administration broke the U.S. immigration system to such an extent that in order to implement its open borders policies, it relaxed immigration laws. Rep. Tom Tiffany (R-WI) claimed that the federal government is running one of the largest human trafficking operations in the world by facilitating the smuggling of migrants through Latin America into the heart of the United States.
With Biden’s arrival at the White House, immigration authorities’ hands were tied in enforcing the laws, so much so that the border crisis escalated, breaking records for illegal migration in decades.
With memos and guidance, Biden orders immigration system to be violated
“This administration has sought from the beginning to relax immigration regulations to such an extent that it has systematically violated American law and jurisprudence,” attorney María Herrera, a specialist in immigration law, explained to El American.
Herrera recounted that Biden has allowed the entry of illegal migrants who are not even referred to immigration judges to have them regularize their status in the country.
“In the last few months we have seen an increasing number of migrants who have arrived in the United States and whom this government has decided to let in without even doing the credible fear interviews that is the basis for humanitarian entry into our country,” she denounced.
Herrera reported that Border Patrol agents and police have their hands tied because the administration has forced them to not comply with immigration laws.
“This administration on the basis of memorandums or guidelines for the implementation of immigration laws, forces Border Patrol agents and police to violate the law to the point that a great majority of immigrants, are not even referred to immigration judges after entering the United States,” she stated.
This is not the first time that details of how Biden would be violating immigration laws to relax the entry of migrants without any type of verification are known.
Last October 13, leaked documents revealed that from August 6 to October 2021 the Biden-Harris administration released approximately 32,000 immigrants through parole.
According to federal law, parole must be used for “urgent humanitarian purposes,” however, according to former Border Patrol officials, Biden would be “abusing” the resource.
“By law and regulation, parole shall only be granted on a case by case basis and only for significant humanitarian reasons or significant public benefit. Neither of these appears to apply to the current situation,” former Border Patrol chief Rodney Scott told Fox News.
The situation is so critical that in July 2021 ICE agents sued Biden for ordering the release of illegal aliens with minor offenses.
The lawsuit brought by Texas sheriffs contends that “many extremely dangerous illegal aliens who would have been detained prior to the February 18 Memorandum consistent with federal statutes are now being released from custody, against the judgment of the ICE officers seeking to detain them, and in violation of federal statutes requiring their detention and/or removal.”
Victor De la Flor, an attorney with the Kivaki Law Firm, told El American that the Biden administration’s loosening of laws, transfer of illegal immigrants in the U.S. and lack of verifications is encouraging smuggling, human trafficking and illegality.
A free hand to smuggling
“When the president orders to ease the illegal entry of immigrants the message given to the smuggling and human trafficking mafias is one of welcome, encouraging them to do their dark work, for which they already earn—even by using threats—thousands of dollars per person,” he said.
De la Flor pointed out that the fact that Biden arrived “without foundation” with the intention of dismantling all the laws of the Trump administration, opened the doors to illegal migration causing a crisis in the immigration system.
“When they started their mandate they had the sole objective of eliminating the policies imposed by Trump, without thinking about the risks and consequences of doing so. And, by not having a clear policy, enough elements came together to create all the chaos that is currently happening,” the specialist added.
While the Biden-Harris administration relaxes the rules, the border crisis is escalating out of control. During FY 2021, authorities detained more than 1.7 million illegal migrants, according to official CBP data; and although ICE usually publishes official figures at the end of the year, the final report is still unknown, which generates uncertainty in the face of numbers that could be even more alarming.
